Coleg Gwent Training Terms and Conditions effect from 25.05.2018


In these Conditions the following expressions shall have the following meanings:

“Coleg Gwent Training” means Coleg Gwent Training Ltd of The Rhadyr, Usk, NP15 1XJ, trading address Royal Chambers, 3rd Floor, High Street, Newport NP20 1FZ.

 The “Client” means the person, company or other legal entity identified as providing a request to Coleg Gwent Training to supply Services.

“Services” means the goods or services to be provided by Coleg Gwent Training to the Client under the terms of the contract and “Services” shall be construed accordingly.

“Confirmation Date” means the date when all the following apply:
- A request to supply Services has been received from the Client by Coleg Gwent Training
- Coleg Gwent Training has confirmed to the Client that the course or other Services requested are available
- Payment has been received or alternative payment method agreed.

“Contract” means the contract between Coleg Gwent Training and the Client under which the Services are to be supplied by Coleg Gwent Training Ltd to the Client

“In-House training” means training delivered by Coleg Gwent Training Ltd on Clients premises

“Open course programmes” means training delivered by Coleg Gwent training Ltd to multiple clients at a Coleg Gwent Training or alternative location from that of the Client

“Working Day” means every day of the week apart from Sunday and statutory holidays.  “Month” means a calendar month.  “Week” means seven consecutive days.

“Intellectual Property” includes all training materials, course manuals, inventions, patent applications, granted patents, registered and unregistered designs, copyright works, trademarks and confidential information.



These terms and conditions should be read and accepted by you prior to your purchase. You accept that by purchasing any of the Services, you agree to be bound by these terms and conditions

By placing an order for Services from Coleg Gwent Training you warrant that you are legally capable of entering into binding contracts on behalf of the Client, and acknowledge that where a purchase order is issued for the ordering of such services, these Terms and Conditions will prevail over any terms and conditions contained within any such purchase order.

Coleg Gwent Training reserves the right to modify these T&Cs without prior notice.  When changes are made, Coleg Gwent Training will notify the changes on the Company's website. If the Client does not accept any changes, the Client shall promptly notify Coleg Gwent Training of such non-acceptance and in such case, the old T&Cs shall govern for the remaining term of Agreement and the new T&Cs shall apply to any new Agreement.



Any prices quoted to the Client for the provision of the open course programmes will be based on prevailing price lists in force at that time. Such price lists are subject to change and amendment at any time.

Prices quoted for the provision of in-house or Consultancy are provided on a bespoke basis, dependent on the Clients’ requirements on a job by job basis, and are only valid for 30 days from the date of any written quote.

Venue hire is quoted to the Client on a bespoke basis, and is only valid for 30 days from the date of any written quote.

All prices are quoted exclusive of Value Added Tax, which will be charged at the appropriate rate.

All fees are subject to annual or other such periodic review and amendment in order to take into account. Coleg Gwent Training reserves the right to accordingly adjust fees at any time, this will not affect those who have already booked on the course at an agreed rate


Payment Terms

Booking implies a commitment to pay the published fees, subject to eligibility for the course booked. If your courses requires you to have a particular qualification, you must confirm that you hold that qualification prior to attending the course.

Deposits, where payable are non-refundable and the balance of the course fee (i.e. the total fee(s) less any deposit paid) is due no later than 30 days before the course starts or immediately if the course is due to start less than 30 days after the booking.

Courses that are over a period of greater than 1 week may be eligible to be paid in instalments, please contact Coleg Gwent Training on 01495 333564 to discuss possible options.

Coleg Gwent Training reserve the right to refuse attendance on any open course programme which has not been paid in advance. Coleg Gwent Training further reserve the right to refuse to deliver any In-house training which isn’t paid in advance, and will be subject to the cancellation terms 

The Client warrants in all instances that where a valid Client purchase order is required to be quoted on any invoices, the Client will provide such purchase order details as necessary in order to facilitate payment in good time and for the full value of any service provided.

Coleg Gwent Training is not liable under any circumstances for the failure of the Client to provide any necessary purchase order information as may be required, and the Client accordingly acknowledges that all fees are due and payable according to Coleg Gwent Training’s terms and conditions in the instances where a valid purchase order has failed to be provided.


Cancellation, Transfers and Substitutions with respect to Training Courses

Coleg Gwent Training reserves the right to cancel or arrange an alternative date for a course.  In such circumstances arise that are beyond our control, it may be necessary from time to time to change/cancel course dates, content, venues and prices from those published. Whilst we will make every effort to transfer your booking to the next available course, it should be noted that we will not be held liable for any costs/losses incurred as a result of any such changes. If Coleg Gwent Training are no longer able to provide your course, we will ask you to return any course materials to us (at our expense) in the condition as originally delivered to you and refund to you any fees paid to date when we receive the materials as required.

Coleg Gwent Training reserve the right to remove from any course, students that fail to comply with its standard practices and procedures. We reserve the right to refuse enrolments and/or suggest alternative arrangements if we believe that it will not be in our best interests of other clients and/or the individual concerned to be enrolled on one of our courses.

The Client may cancel the course booking by notifying Coleg Gwent Training in writing as soon as reasonably practicable.  The Client shall also be deemed to have cancelled the course booking if they do not attend the event.  The Client shall be liable to pay a cancellation fee as follows, no refund will be payable after a course has been started:

Clients may transfer free of charge to any other equivalent price or cheaper course (balance to pay for more expensive course). For cancellations, an administration fee of 5% of the total course fee (plus VAT) will be charged.


Between one week and 24 hours


Clients are entitled to receive a 25% discount on any other training course held within one year from the date of the cancelled course. The new course must be booked within one calendar month of cancellation. No refund is payable.


Between 24 hours and start time of course


No refund. No discounts. No transfers permitted.


Where a Client transfers his/her booking to another course, the Clients will not be entitled to any refund where he/she cancels attendance at that other course. Only one transfer is permitted per course per Client – the fee will be charged as above.

Where a Client has undertaken to order for bespoke/contracted course the cancellation of individual member(s) of the group will not warrant a transfer to a replacement course.


Cancellation respect to room hire


Coleg Gwent Training Ltd will use its best endeavours to ensure that any meeting will go ahead as booked. In such circumstances arise outside that are beyond our control, you are more than 30 days in arrears with any payment or because Coleg Gwent Training have not received comprehensive details of the ICT or other requirements for the meeting at least 24 hours in advance, Coleg Gwent Training reserve the right to cancel the booking. The hirer shall be responsible for any damage caused to Coleg Gwent Training Ltd property.

If the Hirer wishes to cancel the booking, cancellation must be made in writing as soon as reasonably practicable to Coleg Gwent Training Ltd or by calling Coleg Gwent Training Ltd during normal office opening hours.  The Hirer shall be liable to pay a cancellation fee as follows,

  • less than one week's notice of cancellation, 50% of room hire fee will be charged;
  • less than 48 hours' notice, 100% of room hire fee plus catering charges will be charged, if applicable.


Termination of Agreement

This agreement will continue to apply to all training, consultancy and venue hire arrangements provided to the Clients until such time that terms and conditions are changed.

Coleg Gwent Training may at its discretion terminate or suspend this agreement upon 10 days’ notice to the Client if:

  • the Client cases to trade or otherwise terminates business operations
  • becomes insolvent or seeks protection under any bankruptcy, receivership, trust deed, creditors arrangements, composition or comparable proceedings or any proceeding in instituted against the Client;
  • fails to make payment in accordance with the terms and conditions of this Agreement

Coleg Gwent Training may at its discretion immediately terminate or suspend this Agreement if the Client commits a material breach, or a series of breaches the combination of which constitutes a material breach and the Client fails to remedy such breach(es) with 10 days after receipt of notice giving details of breach(es) and requiring them to be remedied.



If you have a complaint about any product or services provided by Coleg Gwent Training Ltd please contact us via the website or telephone 01495 333564. One of our managers will contact you within 10 working days (excepting periods of closure, normally Christmas).

The Manager will investigate your complaint and aim to provide a satisfactory way forward within a further 10 working days, subject to the limited outlines in these terms and conditions.


Data Protection and Confidentiality

The policy of the Organisation with respect to GDPR is detailed in its Web Site privacy Notice which should be read in conjunction with these terms and conditions of contract.

Where programmes are certified training courses, the Client consents to allow Coleg Gwent Training Ltd full access to examination and certification results arising from their bookings.  This information will be used in accordance with the requirements of relevant data protection legislation.  The data will only be used to evaluate effectiveness of training and to assist Coleg Gwent Training Ltd in providing advice to its clients.

All Intellectual Property associated with training courses or other Services shall remain vested in the owner be it Coleg Gwent Training Ltd, and the Coleg Gwent.

Intellectual Property which is identified as, or can reasonably be deemed to be, confidential shall not be copied or reproduced or disclosed to any third party without the prior written consent of Coleg Gwent Training Ltd.  The Client shall ensure that its employees and all those under the Client’s control and supervision comply with this obligation.

Where Services are provided to the specification or special requirements of the Client, the Client shall indemnify Coleg Gwent Training Ltd against all costs, claims and damages incurred or arising out of any alleged infringements of Intellectual Property.
